Commission Terms and Process

 

Commission Terms:

  1. Please make sure to follow the basic guideline.

  2. I reserve the right to decline a commission for whatever reason.

  3. Don't request a commission if you're not ready to pay.

  4. Prepare references and be specific.

  5. Once the commission(s) has been completed, any credit referring to my name (RyanOakley) or social media (preferably my instagram handle: Ryanoakleyart or Twitter handle: mutantx_28) is expected and highly appreciated!

 

Commercial Commission:

  1. By default, you may not use completed work for any Commercial use / Merchandise.

  2. If intended to use the work for Commercial use / Merch, it must be specified in the commission request for a Quote. The price of Quotes depends per client / piece.​

  3. Even with a commercial purchase the artist may use Work in Artist's portfolio (including, but not limited to, any website that displays Artist's works) along with any other marketing strategies. When asked, Client must properly identify the Artist as the creator of Work. Client does not have a proactive duty to display Artist's name together with Work, but Client may not seek to mislead others that Work was created by anyone other than Artist.

  4. I will only send the necessary files for the purpose purchased; You'll only receive full resolution images if a commercial fee was purchased. You do not have any usage rights to sketches or to any preliminary work that is not the final deliverable even with a commercial purchase.

 

Creating a commission:

  1. The first stage consists of 1-2 sketches to deliver for critique. The main goal of this stage is to nail down a desired composition and elements that will be involved. This stage is based off of the descriptions and answers from the above questions. 2 revisions for this stage.

  2. The second stage for traditional work is different. Color preferences should be stated before this stage. Once color is added it is final. Small changes can be made at this point, but major changes that lead to redoing the piece will lead to an additional $50 fee. This does not include the remaining deposit. 

 

Commission Agreement + payment process:

  1. Upon completing this questionnaire and further discussion of details, a letter of agreement and invoice will be drafted. The letter of agreement is a basic contract containing all the details discussed.

  2. Projects with a deadline under 1 month are considered rushed and will have a surcharge that is if I choose to take on the project.

  3. Price of the commission may change depending on the amount of details needed.

  4. After the letter of agreement is authorized, an invoice will be sent directly from my business PayPal. All commissions require a signed contract and a nonrefundable 50% deposit in order to initiate the start of work. When the commission is completed to your satisfaction, the rest of the balance is due before the delivery of the completed and final work. All final files and/or prints will be sent immediately after final payment is completed.

  5. If a client does not wish to purchase the artwork, the deposit will be kept by the artist. The client loses permission to use any part of the work, whether it be sketches or final images.

  6. Tips are appreciated but don't use these to pay for a commission as they're non-refundable + details must be discussed. I reserve the right to decline if you tip with the intention to commission.​

 

Termination/Kill Fee:

  1. The client may terminate this Agreement at any time by sending written notice thereof to the Artist. Upon such termination, Client agrees to compensate Artist as follows:

(1) Partial Completion. If Artist has partially completed the Work, Client agrees to compensate Artist at twenty percent (20%) of the total compensation as an addition to the initial (50%) down payment. 

(2) Full Completion. If Artist has completed the finished artwork at the time of cancellation, Client agrees to compensate Illustrator in full as otherwise provided in this Agreement.

 

Additional procedures and information:

  1. 1 round of revision includes the client thoroughly reviewing the images and consolidating all comments and ideas for the revision. Once all the intended changes are agreed upon then revisions will be made. After this step, there will be a charge starting at $50 for additional edits and will depend on the complexity of the edit.

  2. I aim to take no longer than 1 month to complete commissions where possible - Turnaround time may be affected by other projects / commissions and whether or not you have specified a deadline.

  3. If you do not specify a deadline. Projects without a deadline will take precedence over yours. 

  4. I will send sketches and updates as frequently as necessary depending on the complexity, specifics and your direction.

  5. When commissioning me you agree that the work is being used solely for the purpose communicated, that I retain rights to the work (unless you paid for the rights to the work) and can post it for self promotion / for my portfolio, and that unless otherwise communicated.

  6. Please do not alter or copy the final work in any way - For work purchased without a commercial fee, you are free to use these for non-commercial purposes (such as Avatars, Icons and on Banners).

  7. I will only send the necessary files for the purpose purchased; You'll only receive full resolution images if a commercial fee was purchased.

  8. The artist keeps all hard copy original work that is not the final, which can be purchased at a separate fee. You do not have any right to sketch or to any preliminary work that is not the final deliverable even with a commercial purchase.

  9. Payment of the 50% deposit means the client agrees to the aforementioned policies and agreement.
